What is a wage garnishment?

This is a court judgment used for enforcementCollection of debts. The creditor must apply to the court to issue the debtor the court order, which forces the person's employer to make deductions from their net wages each payday and to submit those deductions to the court. The court then uses the funds to repay the creditor.


Sometimes these orders are also used to collect arrears of municipal taxes. The amount to be deducted is fixed if it is a surveycouncil tax arrears.

Money is deducted from the debtor's wages until all debts are repaid, which can take weeks, months, or even years.

Is a wage garnishment a CCJ?

A Judgment of the District Court (CCJ)is not equivalent to a garnishment of wages.

However, before a creditor can apply for a wage garnishment, the debtor must have been issued with a judgment of debt by the District Court. If the person does not have a CCJ, they cannot apply for a wage garnishment just yet.

In order to obtain a CCJ, the creditor must have gone through a rigorous collections process regulated by the Financial Conduct Authority, including payment reminders and collection orders.

If they have exhausted this process and still do not receive payment or agree on a repayment schedule, they can apply to the court to issue a CCJ.

This is not the only requirement for creditors to apply for attachment. Along with a CCJ, the individual must:

  1. At least £50 in debt
  2. Have an employer (self-employed persons cannot be subject to the court order as there is no employer to deduct from monthly wages)
  3. Not being in the armed forces (a different procedure is used to deduct from a salary)
  4. Not working on a boat (except fishing boats)

Why did I receive an earnings supplement?

The district court will notify the person in writing that the creditor has requested that money be deducted from your salary.

At the same time you will receive an income statement in which you will be asked to declare your income. This is used to find out how much you have to pay.

You will only receive one of these requests after receiving a CCJ.

In the past, you could only place the order if you missed a payment, but today you can hand the order over to the CCJ as soon as you place it. However, it is unusual for a creditor not to give you a chance to repay the debt owed first.

You usually have to avoid the CCJ and your debt for it to get that far.

Can you stop a garnishment?

You can use the forms that the courts will initially send you to submit an application to the courtthe arrangement be suspendedso you can pay the creditor directly.

This can happen, among other things, if the garnishment of wages would lead to the loss of a job. This is only possible for a few people who work in the financial industry.

If you were to lose your wages as a result, the court order would be worthless and may be suspended.

Remember that the order is only suspended, i. H. becomes active if you have not met your agreed repayments.

Another argument you could make against a wage garnishment is that the order would make it harder for you to pay important bills. You would have to prove your argument, usually with a monthly oneBudget sheet.

How long is a wage garnishment valid?

An appendix to the order of earnings remains in placeuntil enough has been deducted from your income to pay off the debt in full, including all interest and fees.

There are limited times when the Wage Garnishment Order is terminated earlier, for example in combination with an Administrative Order which may only last three years.

What if I get a new employer?

If you change jobs and have a new employer, you must notify them of the judgment and order within seven days.

Hiding your new employer is a criminal offence. If you become self-employed instead, you should inform the court.

What if I'm sick?

Statutory sick pay is deductible but is less than the guaranteed amount you are required to receive. So if you only receive this type of payment, no deductions will be made to you.

I'm on maternity leave...

If you receive statutory maternity benefit, none of this is deductible.

Will an earnings appendix appear on my credit report?

The merit order attachment does not appear on yourcredit report. However, the events that led to you receiving a wage garnishment order, namely arrears and the district court ruling.


A CCJ on your credit report can adversely affect your future access to other types of credit, such as personal loans, credit cards, and even a mortgage.

However, a CCJ is automatically deleted from your credit file after six years. You also have the opportunity during this time to improve your credit score and still access credit.
